This Privacy Policy explains how Empty Chair (“Empty Chair,” “we,” “us,” or “our”) collects, uses, and shares information when tattoo shops, their staff, and customers use our websites, applications, and related services (the “Service”).
1. Information we collect
We may collect account and shop information, including names, email addresses, phone numbers, shop details, artist profiles, login information, and settings. Shops may upload customer contact details, appointment history, preferences, consent records, and booking information. We also collect opening, offer, claim, deposit, calendar, delivery, and support information generated through the Service.
We may automatically collect device, browser, IP address, usage, diagnostic, cookie, and security information. Payment card details are processed by Stripe; Empty Chair does not store complete payment card numbers.
2. How we use information
We use information to provide and secure the Service; match available appointments with eligible customers; deliver requested email or text notifications; process claims, deposits, subscriptions, and payouts; connect calendars; provide support; prevent fraud and abuse; analyze and improve performance; comply with law; and enforce our agreements.
3. Shops are responsible for customer data
A shop controls the customer information it submits and is responsible for having a lawful basis and any required consent to collect, upload, and use that information. Shops must honor customer privacy and messaging choices. We process shop customer data to provide the Service and on the shop’s instructions.
4. How we share information
We may share information with the shop associated with an appointment; service providers that support hosting, email, text messaging, payments, analytics, calendar connections, security, and customer support; professional advisers; authorities when legally required; and a successor in a merger, financing, acquisition, or sale. We do not sell customer contact lists or share them for third-party cross-context behavioral advertising. Mobile phone numbers, SMS opt-in data, and messaging consent are not shared with third parties or affiliates for their own marketing or promotional purposes.
5. Retention and security
We retain information for as long as reasonably necessary to provide the Service, meet legal and accounting obligations, resolve disputes, and enforce agreements. We use reasonable administrative, technical, and organizational safeguards, but no system is completely secure.
6. Your choices and rights
You may update account information through the Service or contact us to request access, correction, or deletion. Certain information may be retained when required by law or for legitimate security, fraud-prevention, accounting, or dispute-resolution purposes. Customers should ordinarily direct requests about shop-controlled data to the relevant shop.
You may opt out of marketing email using its unsubscribe method. For text messages, reply STOP to opt out or HELP for help. Message and data rates may apply.
7. Children
The Service is intended for business users and adults seeking tattoo appointments. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
