Terms of Service

These Terms of Service (“Terms”) govern access to and use of Empty Chair’s websites, applications, and related services (the “Service”). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 and able to enter a binding agreement. You are responsible for accurate account information, safeguarding credentials, and all activity under your account. Business users represent that they have authority to bind the shop they identify.
2. The Service
Empty Chair helps shops identify openings, contact eligible customers, collect claims or deposits, and coordinate bookings. Empty Chair is a software provider, not a tattoo shop, artist, healthcare provider, payment institution, or party to the tattoo service transaction. Shops remain solely responsible for tattoo services, licensing, sanitation, age verification, informed consent, pricing, refunds, scheduling, customer disputes, and compliance with applicable law.
3. Customer data and communications
You may submit customer information only when you have the right to do so. You are responsible for all legally required notices and consents and for maintaining accurate consent and opt-out records. You may not use the Service to send unlawful, deceptive, abusive, discriminatory, or unwanted communications. You must promptly honor opt-out and consent-revocation requests.
4. Subscriptions, deposits, and fees
Paid plans renew at the disclosed interval until canceled. You authorize applicable recurring charges and agree to keep payment information current. Founding Shop Pilot pricing lasts for the disclosed 90-day pilot period, and we will request your approval before applying a later price change. You may cancel future renewals at any time. Unless required by law or covered by the stated pilot performance guarantee, subscription fees are nonrefundable. Under that guarantee, a shop that submits at least four legitimate openings during its first subscription month may request a refund of that month if Empty Chair fills none. Shops establish their own appointment and deposit policies and are responsible for communicating and applying them lawfully. Payment processing may be subject to Stripe’s terms.
5. Acceptable use
You may not misuse the Service, interfere with its operation, attempt unauthorized access, reverse engineer it except where law permits, introduce malicious code, scrape it at unreasonable volume, violate another person’s rights, or use it to violate any law or platform rule.
6. Ownership
Empty Chair and its licensors own the Service, branding, software, and related materials. You retain ownership of information you submit and grant us a limited right to host, process, transmit, and display it as needed to operate and improve the Service and fulfill your instructions.
7. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for nonpayment, material breach, unlawful conduct, security risk, or harm to the Service or others. Provisions that by their nature should survive termination will survive.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT AN OPENING WILL BE FILLED, A CUSTOMER WILL APPEAR, A PAYMENT WILL SUCCEED, OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EMPTY CHAIR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID EMPTY CHAIR DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.
10. Changes and contact
